Candidacy Annulment: Omo-Agege Seeks Leave Of Court To Appeal Judgment

Senator Ovie Omo-Agege, representing Delta Central senatorial district, has seek the leave of court to appeal the Federal High Court Asaba’s judgment which sacked the Jones Erue -led APC state executive committee which conducted primaries that produced him.
Omo-Agege, it was learnt as an impacted party wants to appeal the court judgment which annulled his candidacy and that of the party’s governorship candidate, Chief Great Ovedje Ogboru and others.
The lawmaker had in the past few days argued that he will not be affected by the judgement because he was not made a party to the case, and that his candidacy came into being by virtue of a consent judgement that has not been set aside.
Besides him, the member-elect for Ughelli North, South and Udu Federal Constituency,Rev Francis Waive is also in court to seek leave of court to appeal the judgment.
Omo-Agege and Waive had through their counsel Barr. Alex Iziyon, SAN, while seeking the leave of the court to appeal the judgement, filed an exparte motion which was granted to enable them serve Chief Cyril Ogodo by pasting service at the state party secretariat in Asaba.
Recall that the Federal High Court 1, Asaba, in its March 18, 2019, judgement delivered by Justice Toyin Adegoke sacked the Prophet Jones Erue-led factional State Executive Committee, instead upholding the Chief Cyril Ogodo faction as the authentic party’s State Executive Committee.
The court also in its judgement annuled all action taken by the sacked Jones Erue-led executive committee, including party primaries and the list of candidates which emerged from their factional primaries declaring it null and void.
