Contemptuous Coronation: Rights Group Reports Gov. Adeleke To CJN Over Flagrant Disobedience To A’Court Judgement On Alawo Chieftaincy Stool

A human rights body, the Centre for Human Rights and Social Justice (CHRSJ) has written a Petition Letter to the Chief Justice of Nigeria (CJN) and Chairman, National Judicial Council (NJC), Honourable Justice Olukayode Ariwoola, GCON, reporting the Osun State Governor, Senator Ademola Jackson Nurudeen Adeleke over the flagrant disobedience to Appeal Court Judgement of Akure Judicial Division in Appeal N0: CA/AK/58/2021 and also appeal before the Supreme Court of Nigeria in SC/CV/1079/2022 on Alawo Chieftaincy Stool.

It stated that the Petition Letter was as a result of the Governor Ademola Adeleke plan to present the Staff of Office to a deposed new Alawo,Mr. Adegboye Taiwo Abdulrasaq on the 9th of December,2023, in flagrant disregard to the Appeal Court Judgement that had nullified the selection/or election, approval, appointment and subsequent installation of Adegboye.

The group stressed that the unanimous Appeal Court Judgement also warned the State Government over disrespect to Court pronouncements by restraining Adegboye Taiwo Abdulrasaq from parading himself as or performing any of the functions of the Alawo of Awo or wearing or displaying any insignia of the office of Alawo of Awo, including beads,crowns, and all other paraphernalia of the stool and also awarding a sum of Eight Hundred Thousand Naira (N800,000) against Adegboye as Appellant.

Meanwhile, it has been widely reported in the media that Adegboye forged no fewer than nine(9) documents including; selection documents, identity theft of Notification of National Diploma (ND) and Higher National Diploma (HND) Results and NYSC Certificate, perjury and falsification of dates of birth, which have been the subject of investigation by the security agents and other anti-graft agencies and other agencies of government, for his earlier appointment as new Alawo before the Appeal Court Judgement nullified the illegal appointment and subsequent installation.

According to the statement issued and signed by the CHRSJ’s Assistant General Secretary (AGS), Pastor Michael Agaasi and copies were made available to newsmen on Friday, described all the plan actions of Governor Adeleke on the subject matter as illegal, unconstitutional, uncalled for, aberration, abomination, null and void and an affront to the rule of law in the land.

Pastor Agassi,while supporting his argument with the Supreme Court Judgement in the case of ABACHA V. FAWEHINMI (2002)2 SCNQR 489 at 546 held thus :”…. It is the law that a decision of a Court of competent jurisdiction,no matter that if seems palpable null and void, unattractive or unsupportable, remains good law and uncompromisingly binding until set aside by a superior Court of competent jurisdiction”.

While commending the Chief Justice of Nigeria (CJN) and Chairman,National Judicial Council (NJC), Honourable Justice Olukayode Ariwoola,GCON, for standing on the truth on the subject matter of reference numbers: NJC/S.29/HC.08/17/1/394 and NJC/S.29/HC.08/17/1/485 respectively, praying to God to continue give him Solomon wisdom to pilot the affairs of the third arm of government in the land to the greater height.

Quoting from the part of the Petition Letter thus; “Our Lordship Sir, this is to draw the attention of your good office to the very unfortunate occurrence that a son of Presiding Judge of Court of Appeal,Lagos Division is the current Osun State Attorney-General and Commissioner for Justice,Mr. Wole Jimi-Bada who ill-advised the State Governor, Senator Ademola Adeleke who Sworn to an Oath of Office to always uphold the Constitution of the Federal Republic of Nigeria and defend the Rule of Law,urged the Governor to go ahead with executive impunity, executive lawlessness, executive recklessness and disrespect of the Appeal Court Judgement in Appeal N0: CA/AK /58/2021 and Supreme Court of Nigeria in SC/CV/1079/2022 with contemptuous Coronation and presentation of Staff of Office to a deposed new Alawo (MR. Adegboye Taiwo Abdulrasaq) in contrary to a strong advice from the State Ministry of Local Government and Chieftaincy Affairs that once the Court of Appeal had given its Judgement on the Alawo Chieftaincy Stool and Appeal still ongoing before the Supreme Court of Nigeria, they should abide with the Appeal Court Judgement until the Supreme Court says otherwise.

“But the same Governor Ademola Adeleke who wanted to remove Osun State Chief Judge (CJ), Justice Oyebola Adepele Ojo in a clandestine manner with palace coup so as to put the Judiciary under his kneel, disrespect the Appeal Court Judgement on the subject matter and gave accelerated approval to the illegal actions on the subject matter(Alawo Chieftaincy Stool) because of Honourary Chieftaincy Title to be conferred on the Governor’s immediate elder sister,Mrs. Dupe Adeleke Sanni and her husband,Mr. Aderemi Sanni,when there are many legitimate Obas(Traditional Rulers) in Osun State that could give such a Chieftaincy title rather than from a deposed monarch and alleged serial forger which the State Government under Governor Ademola Adeleke refused to investigate because of political inuendos.

“However, the Appeal Court, Akure Judicial Division in Appeal N0: CA/AK/58/2021, had given its verdict on Alawo Chieftaincy Stool where Adegboye Taiwo Abdulrasaq was an appellant and also an appellant before the Supreme Court of Nigeria in SC/CV/1079/2022 and the same appellant was not ready to abide by the verdict of the Court of Records,that is Appeal Court Division and Supreme Court of Nigeria.

“It is trite in law that when a matter is before the Court of competent jurisdiction,all the parties; including,litigants and government involved,should maintain ‘Status Quo’ pending the determination of such matter but on this matter, Appeal Court had given its Judgement and the same appellant had approached the Supreme Court for final adjudication and the same appellant in collaboration with Governor Ademola Adeleke were poking fingers into the eyes of the law by resulting to self-help.

“Honourable CJN Sir, Adegboye Taiwo Abdulrasaq, because he was former Councilor in Egbedore Local Government area of Osun State, believing that he is above the law of the land and he could manipulate the law in his favour by violating the law at Will.”

Although, Adegboye still parading himself as new monarch of the ancient town in flagrant disregard to Judgement of the Appeal Court by subjecting the ancient town of Awo to a big disgrace and laughing stock among the comity of the community in the State.

Sir, Adegboye continue to parade himself as new Alawo because of Osun State Governor, Senator Ademola Jackson Nurudeen Adeleke refusal to implement the Appeal Court Judgement which lead to the ongoing plan by the Governor Ademola Adeleke to present Staff of Office at the acclaimed 2nd year Coronation to a deposed Adegboye on December 9th,2023.

We are appealing to use your good office to save the people of Awo community from COMMUNAL CRISIS as result of proposed illegal action of the State Government.

However, Adegboye Taiwo Abdulrasaq was an APPELLANT in the Appeal Court N0: CA/AK/58/2021and also an APPELLANT before the Supreme Court of Nigeria in SC/CV/1079/2022 and the same APPELLANT was not ready to abide by the verdict of the Court of Records,that is Appeal Court Division and Supreme Court of Nigeria.Attached is the Certified True Copy of the Enrollment of Judgement of the Appeal Court of Akure Judicial Division dated 8th August,2022, which SACKED and DEPOSED Adegboye for being the beneficiary of the illegality for the purpose filing the vacant Stool of Alawo as Evidence (1).

It is trite in law that when a matter is before the Court of competent jurisdiction,all the parties; including,litigants should maintain ‘Status Quo’ pending the determination of such matter but on this matter, Appeal Court had given its Judgement and the same APPELLANT had approached the Supreme Court for final adjudication and the same APPELLANT(ADEGBOYE) in COLLABORATION with the Governor Ademola Adeleke were poking fingers into the eyes of the law.

Honourable CJN Sir, Adegboye Taiwo Abdulrasaq was claimed to disrespect the Court of Appeal Judgement because he was former Councilor in Egbedore Local Government area of Osun State, believing that he is above the law of the land and he could manipulate the law in his favour by violating the law at Will.

Meanwhile, another forgery of no fewer than nine (9) documents have been discovered in favour of Adegboye Taiwo Abdulrasaq in respect of Alawo Chieftaincy Stool and the said documents ranging from FORGERY of Selection Documents/Minutes, FALSIFICATION of Dates of Birth, PERJURY and Identity THEFT of POLYTECHNIC Notification of Results, NYSC Certificate with other fake and forged documents attached to Expression of Interest Form Number: 000000114,for the purpose of filing the vacant Stool of Alawo of Awo in Egbedore Local Government Area of Osun State.

The documents also submitted to Osun State High Court,Ede Judicial Division to get favourable judgement in Suit N0: HED/26/2020 and all these documents were used by Adegboye to mislead the Osun State Government through the Ministry of Local Government and Chieftaincy Affairs,Government Secretariat,Abeere, Osun State to appoint him as monarch illegally at the first instance.

Sir, this is to inform your good office that Mr. Adegboye Taiwo Abdulrasaq was imposed on the Stool by Osun State Government on 13th of September,2021, apart from alleged forgery scandal but with wrong law of 1957 Declaration instead of subsisting 1979 Registered Alawo of Awo Chieftaincy Declaration and in flagrant disobedience to Court Orders with Appeal Court Judgement.

The said documents attached to this PETITION LETTER are highlighted below;

-The Certified True Copy of Adegboye Taiwo Abdulrasaq’s Expression of Interest Form Number: 000000114, to fill the vacant stool of Alawo with different thumbprint impression and signature of Secretary, Abioye Ruling House/Compound,Awo. Attached as Evidence (2).

-The Certified True Copy of the Covering Letter with Reference N0:ELG.396/T/28B,dated 24st August,2020 and signed by one Mrs. Olabimtan F. Abiola, the Council Manager for Chairman Egbedore Local Government,Awo with attachment of Selection Minutes with different thumbprint impression, signatures and typing characters. Our LORDSHIP Sir, it is very unfortunate that according to the claim of Adegboye Taiwo Abdulrasaq,was that he changed his name from ‘ABUDULIE’ to ‘ABDULRASAQ’ after obtained the acclaimed NYSC Certificate by bearing ‘ADEGBOYE TAIWO ABUDULIE’ to obtain West Africa Examination Council (WAEC) in 2001 with Candidate No:4291121006 & Certificate No:NGWASSCS 2682561, National Diploma (ND)in 2005, Higher National Diploma (HND) in 2008 and NYSC Certificate in 2009 but changed his name to contest for Alawo Stool from “ABUDULIE’ to “ABDULRASAQ” and this suspicious of identity theft which means he does not know his real ‘MUSLIM’ name before he went to the Polytechnic and as well observed a year MANDATORY National Youth Service Corps(NYSC).

The above is smelling to be a pure issue of another criminal forgery with identity theft by Adegboye Taiwo Abdulrasaq and also shown that his late twins brother was the real owner of the WAEC-SSCE CERTIFICATE, Polytechnic Notification of Results and NYSC Certificate bearing ‘ADEGBOYE TAIWO ABUDULIE’, while the present person who is illegally occupying the stool of Alawo of Awo is bearing “ADEGBOYE KEHINDE ABDULRASAQ” because the twins brothers look alike. “THIS IS A BIG IDENTITY THEFT OF THE YEAR?”

Even, the Polytechnic Notification of National Diploma (ND) Result and Higher National Diploma (HND) Result awarded and obtained at different years respectively bearing the same Reference N0: SO1/MKT/2003/0354, which implies that Adegboye Taiwo Abudulie(ABDULRASAQ) was admitted to study both National Diploma (ND) and Higher National Diploma(HND) by Rufus Giwa Polytechnic,Owo, Ondo State, at the same year 2003.

Sir,the fundamental question now is that who is bearing ADEGBOYE TAIWO ABUDULIE and ADEGBOYE TAIWO ABDULRASAQ?

OUR DEMAND
Since inception of our current democratic experiments,judiciary has distinguished itself as an impartial arbiter that treasures its independence above all other considerations except justice, equity and fairness.CHRSJ still aligned with the demands as contained in its letter dated Tuesday, 1st of November,2022 and forwarded to the Office of the Chief Justice of Nigeria (CJN).

More over Sir, the position of the Supreme Court of Nigeria,is cleared in the case of PDP & 2 Ors. V. Biobarakuma Degi-Eremieyo & 3Ors.-SC.1/2020.

And the position of the Apex Court of the land,is also cleared without any ambiguity in line with Sections of the amended 1999 Constitution succinctly stated that a person shall not be qualified for election/or selection to the position of authority, “ if he has presented a forged certificate to the Umpire .” and Section 467, Criminal Code Act (Nigeria) states that; “Any person who forges any document, writing, or seal, is guilty of an offence which, unless otherwise stated, is a felony, and he is liable if no other punishment is provided, to imprisonment for three(3) years.”

Recently,a five- man panel of the Supreme Court of Nigeria sacked a Federal Legislator from Benue State for Certificate forgery, Honourable Justice Sidi Bage,who read the lead judgement spoke a soothing language of hope,that ;”Allowing criminality and Certificate forgery to continue to percolate into the streams ,waters and oceans of our National polity/Chieftaincy Stool,will only mean that our waters are and will remain dangerously contaminated.The purification efforts must start now and be sustained as we seek as a nation,to now change from our old culture of reckless impunity.

Justice Bage went further: ” The Nigerian Constitution is supreme. It desires that no one who has ever presented a FORGED Certificate to an umpire should contest election (selection) into the any elective office (including Chieftaincy Stool office in this regard). This is clear and sacrosanct.

Bage stressed further that the message is simple, we are bound to continue to fail as a nation if we do not sanitize our political/traditional institutions by fearlessly getting rid of those individuals whose actions have become our development albatross.

However,the fate of many Nigerians has been strengthened by the strong and firm declaration and reassurance of the Apex Court of the Land that has come down hard on those consciously slowing down our development through forgery, falsification, perjury and other related offences.

This is high time to name and shame anybody who involved in forgery of documents to occupy a position of authority like subject matter of this PETITION LETTER by just robbed other contender as COMMON CRIMINAL.

It is very unfortunate that some certain elements like acclaimed Adegboye Taiwo Abdulrasaq to be entrusted with Chieftaincy Stool, indulge in forgery, perjury, identity theft and falsification of age and these are ordinary citizen that should be leading by an example of what a good society should be.

Moreover, Adegboye Taiwo Abdulrasaq perpetrated all these evil acts of FORGED Selection Documents/Minutes, Identity THEFT of Polytechnic Notification of Results and NYSC Certificate, FALSIFICATION of Age, and other dastard act in respect of SELECTION, ELECTION,APPOINTMENT,APPROVAL and SUBSEQUENT INSTALLATION of new Crown Prince for the Alawo Chieftaincy Stool, all in the name of desperation to outsmart the second contender for the STOOL in person of Comrade (Prince) ADENIYI ALIMI SULAIMAN,the Executive Chairman,Centre for Human Rights and Social Justice (CHRSJ).

As a human rights organization with respect for the rule of law,as stipulated in the amended 1999 Constitution of the Federal Republic of Nigeria and criminal code that the criminal action can be instituted against any COMMITTER at anytime except those who elected into the EXECUTIVE positions in the Country where they are covered by Section 308 of the amended 1999 Constitution pending the time of expiration of holding such an office.

The Supreme Court of Nigeria declared that it is trite principle of law to obey the order of the Court as contained in the case of ABACHA V. FAWEHINMI (2002)2 SCNQR 489 at 546 thus :”…. It is the law that a decision of a Court of competent jurisdiction,no matter that if seems palpable null and void, unattractive or unsupportable, remains good law and uncompromisingly binding until set aside by a superior Court of competent jurisdiction”.

So,if the State Government under Governor Ademola Jackson Nurudeen Adeleke would do any coronation in this respect,the Apex Court,that is Supreme Court of Nigeria should have allowed to say otherwise on the subsisting Appeal Court Judgement in respect of Alawo Chieftaincy Stool.

Lastly Sir,we will conclude this PETITION LETTER with the imperishable statement that Adegboye Taiwo Abdulrasaq is a desperate office seeker who is only interested in self serving, and does not mind if the entire Awo community goes up in flames,so long as his own nest is fested.Of course, history is replete with cases of Princes who have destroyed their kingdom for selfish aggrandizement.
