Alleged Court Nullification Of Delta South APC Primary: I Was Never Aware Of The Case – Uduaghan

Dr Emmanuel Uduaghan, the immediate past governor of Delta State has reacted to media reports that his APC Delta South senatorial district candidacy has been nullified by an Abuja High Court.

Uduaghan on Tuesday said he remains the candidate of the APC for Delta South, because according to him, the court had no time ordered the Independent National Electoral Commission (INEC) to remove his name from the list of candidates in the election.

BIGPEN ONLINE had reported that a high court in Abuja nullified the All Progressive Congress, APC Delta South senatorial primary on Monday following a suit filed by Air Vice Marshal Terry Okorodudu (retd.) who was also an aspirant who was contesting for the APC Delta South ticket.

The retired Air Force boss had approached the court seeking an order to nullify the said primary that produce Uduaghan which according to him was granted on Monday by the court.

The court, according to Okorodudu had declared the nomination of Uduaghan as APC Delta South senatorial district candidate a nullity and ordered APC to conduct fresh primaries for Delta South Senatorial District to be monitored by INEC.

But reacting to the alleged judgment, Uduaghan said that he was never aware of the case nor was he a party to the case and was never joined in the alleged suit.

The former governor who spoke through his media assistant, Monoyo Edon, however said he has instructed his lawyers to take necessary legal steps on the matter, even as he enjoins APC party faithful and supporters to come out en mass to vote the party and all its candidates to victory in the elections.

His statement reads in full: “The attention of His Excellency, Dr. Emmanuel Eweta Uduaghan, the Delta South senatorial candidate of the All Progressives Congress (APC) in this Saturday Presidential and National Assembly Elections has been drawn to a High Court Judgment allegedly nullifying the Delta South APC primaries where he emerged as the candidate of the party.

“We wish to clarify that His Excellency, Dr. Emmanuel Eweta Uduaghan, was never aware of the case nor was he a party to the case and was never joined in the alleged suit.

“The court had no time ordered the Independent National Electoral Commission (INEC) to remove the name of Dr. Emmanuel Eweta Uduaghan from the list of candidates in the election.

“Dr. Emmanuel Eweta Uduaghan has instructed his lawyers to take necessary legal steps on the matter, even as he enjoins APC party faithful and supporters to come out en mass to vote the party and all its candidates to victory in the elections.

“We wish to state categorically that His Excellency, Dr. Uduaghan remains the candidate of the APC for Delta South and we are confident of winning the election”, the statement concluded.

Meanwhile, BIGPEN ONLINE had reported that Uduaghan has the option of filling for a stay of execution and at same time appealing the judgment.
