Delta: Group Files Law Suit Against DSIEC At Fed High Court Abuja, May Stop Council Elections

The group, Delta Stakeholders Group (DSG) has made good its threat to challenge the new Delta State Independent Electoral Commission, DSIEC law by filing a law suit at the Federal High Court Abuja, the nation’s capital.
Prince Henry Efe Duku, Director of Communication and Strategy for the group disclosed this in a statement on Tuesday.
He recalled that recently, the Delta Stakeholders Group (DSG) informed Deltans about serious problems with the new DSIEC Law enacted by the Okowa’s administration.
Duku said that DSG was challenging the law because the “law is very bad” abinitio.
According to him, the law violates the 1999 Constitution and conflicts with the Electoral Act in many areas.
“The Law was made to promote fake and rigged LGA elections for Okowa’s PDP. Clearly, the Delta State House of Assembly (DTHA) made itself a laughing stock by passing the law at all”, he added.
He said that with the benefit of broad consultation, the DSG decided to take strategic actions to checkmate the creeping tyranny of the Okowa regime, declaring that a Suit No. FHC/ABJ/CS/1118/2017 was filed in the Federal High Court Abuja to, amongst others, –
a. get a judicial declaration that the DSIEC Law is unconstitutional, null, void and of no effect whatsoever to the extent that it violates the Constitution and the Electoral Act (on the doctrine of ‘Covering the Field’ which forbids a State House of Assembly from making laws that are inconsistent with Acts duly enacted by the National Assembly);
b. restrain or prevent the Independent National Electoral Commission (INEC), Inspector-General of Police (IGP), Attorney-General of Delta State, Attorney-General of the Federation (AGF) and Director-General (DG) of the State Security Service (SSS) from taking any step in support of DSIEC’s implementation of the bad law. In this regard, we specifically seek, amongst others, to stop INEC from releasing its Voters Register to DSIEC to conduct the proposed Local Government elections and forbid the Nigerian Police and SSS from providing security for any LGA election founded on the bad law; and
c. sack anyone (Chairman or Councilor) who may be ‘elected’ or imposed on our people on the basis of the bad law.
He however concluded that “DSG is convinced that it has become necessary to curtail the excesses of the Okowa regime.
“We cannot in good conscience continue to allow Okowa to continue his dream that Delta is his private property to be used, enjoyed and abused as he desires.
“We are grateful to prominent Deltans who fully support this action and other outlined lawful steps to be taken against the Okowa regime for its countless indiscretions”.
